Scope of Services

We provide rubbish clearance and waste collection services for domestic and commercial customers, including removal of general household waste, unwanted furniture, appliances, garden waste and certain types of commercial waste. The exact services to be provided will be described in our quote or booking confirmation. We reserve the right to refuse the removal of any items that are unsafe, prohibited, excessively heavy, contaminated or fall outside the agreed service description.

Our services are limited to the physical removal, loading, transportation and disposal or recycling of waste. We do not provide professional cleaning, building work, demolition, electrical services, plumbing services or any other services beyond waste clearance unless expressly agreed in writing.

Booking Process

You may request a booking for our rubbish clearance and waste collection services by telephone, email or through any booking channel we make available. When you make an enquiry, we may ask you for details including the type and approximate volume of waste, access information, the site address, and your preferred date and time.

We may provide an estimated quote based on your description or, where necessary, arrange a site visit before confirming a price. Any quote provided based solely on information given by you is an estimate only and may be subject to change once our team attends the site and assesses the actual waste and access conditions.

A booking is only confirmed when we communicate our acceptance of your order, provide a booking confirmation, or attend the site to begin work, whichever occurs first. We reserve the right to refuse any booking at our discretion, including where the waste type is unsuitable, where access is impractical or unsafe, or where we have capacity constraints.

Access and Customer Responsibilities

You are responsible for ensuring that our team has safe, reasonable and lawful access to the premises at the agreed time. This includes arranging any parking permissions, gate or building access, lift access, and providing clear instructions to reach the waste. You must ensure that the waste to be collected is accessible and not obstructed by locked doors, parked vehicles, construction work or other impediments.

If we are unable to carry out the service at the agreed time due to lack of access, health and safety concerns, or inaccurate information provided by you, we may charge a call-out fee or apply our cancellation policy. You agree to provide accurate information regarding the nature, volume and weight of the waste, and to inform us in advance of any hazardous substances or special handling requirements.

Waste Types and Prohibited Items

We operate in accordance with applicable UK waste regulations and may only collect waste that we are legally permitted and licensed to handle. Certain items and materials are prohibited or restricted, including but not limited to asbestos, medical or clinical waste, biological waste, corrosive substances, explosives, gas bottles or cylinders, large quantities of chemicals or solvents, radioactive materials, and any other hazardous or regulated waste for which we do not hold the required licence.

If you present waste that is prohibited or for which we are not authorised, we may refuse to remove it, and you may be charged for any time spent on site. If prohibited or hazardous items are mixed with otherwise acceptable general waste, we may refuse to collect the entire load or charge additional fees for segregation, specialist handling or lawful disposal.

Pricing and Quotations

Prices for our rubbish clearance and waste collection services are normally based on factors such as volume, weight, type of waste, labour required, access conditions and disposal costs. We may provide a quote as a fixed price or as an estimate. Where a price is described as an estimate, the final charge will be determined on site once we have inspected the waste.

If the actual waste or access conditions differ from your description, we reserve the right to revise the quoted price before commencing work. In such cases, you will have the option to accept the revised price or decline the service. If you decline, a call-out charge may apply to cover our time and travel costs.

All prices are stated in pounds sterling and may be subject to applicable taxes. We may revise our pricing structure at any time; however, changes will not affect confirmed bookings unless the scope of work has been altered by you.

Payments and Invoicing

Payment terms will be confirmed at the time of booking. Unless otherwise agreed in writing, payment is due on completion of the service on the day of collection. We may request a deposit or pre-payment for larger jobs, commercial contracts or where there are special disposal requirements.

We accept various payment methods, which may include cash, bank transfer and card payment, subject to availability. You authorise us to take payment using the agreed method for the total amount due, including any additional charges incurred under these Terms and Conditions.

For business customers with approved credit arrangements, invoices are typically payable within the timeframe stated on the invoice. We reserve the right to charge interest and recovery costs on overdue amounts in accordance with applicable UK law.

Cancellations and Amendments

You may cancel or amend your booking subject to the provisions in this section. To do so, you must contact us by telephone or email using the details provided at the time of booking. We will confirm any cancellation or amendment in return.

If you cancel more than 24 hours before the scheduled start time, we will normally cancel the booking without charge, unless a non-refundable deposit was expressly agreed. If you cancel within 24 hours of the scheduled start time, we reserve the right to charge a cancellation fee to cover allocated labour and vehicle costs.

If our team attends the site at the agreed time and is unable to carry out the service due to lack of access, issues with parking, refusal of service by you, or the presentation of prohibited waste, this will be treated as a late cancellation and a call-out charge or cancellation fee may be applied.

We will use reasonable efforts to accommodate requests to change the date, time or scope of a booking, but such changes are subject to availability and may result in revised pricing.

Our Right to Cancel or Reschedule

We may cancel or reschedule a booking if we are unable to attend due to events outside our reasonable control, including severe weather, vehicle breakdown, staff illness, accidents, or legal restrictions. In such cases, we will notify you as soon as reasonably practicable and offer a new appointment time. We will not be liable for any indirect or consequential loss arising from such cancellation or delay.

We may also cancel the service or withdraw from a site where we consider that conditions present a risk to health and safety, where the waste to be collected is significantly different to that described, or where you request us to carry out work that would be unlawful or unsafe. In such circumstances, we may charge a reasonable amount for time spent on site and any costs already incurred.

Performance of Services

On arrival, our team will assess the waste and access conditions and confirm the service to be provided and the final price where applicable. Once you have agreed, we will proceed to load and remove the waste in a safe and efficient manner.

We will take reasonable care to avoid damage to property when performing the services. However, you should take sensible precautions, such as removing fragile items from the work area and informing us of any particular risks or vulnerable surfaces. You accept that minor scuffs or marks can occur when removing bulky items from confined spaces.

Waste Transfer and Environmental Compliance

We are committed to conducting rubbish clearance and waste collection services in line with applicable UK environmental and waste management regulations. We will transport waste only to authorised facilities for reuse, recycling, recovery or disposal. Where required, we will complete appropriate documentation such as waste transfer notes to record the movement of waste from your premises.

Once waste has been loaded onto our vehicle and any required documentation has been completed, ownership of that waste transfers to us, and you relinquish all rights to the items removed. We may choose to reuse, recycle, donate, resell or dispose of the materials as we determine appropriate, subject to legal requirements.

Customer Warranties

By using our services, you warrant and represent that:

You are either the owner of the waste and have full authority to arrange its removal, or you have obtained all necessary permissions from the owner or occupier of the premises.

The waste does not include prohibited items or hazardous materials that you have failed to disclose.

Any information provided to us regarding the waste, premises and access is accurate and complete to the best of your knowledge.

You will not request or encourage our team to do anything unlawful, unsafe or outside the agreed scope of service.

Liability and Limitations

Nothing in these Terms and Conditions excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for any other matter for which liability cannot be lawfully excluded or limited under UK law.

Subject to the above, our total liability to you for any loss or damage arising out of or in connection with the services, whether in contract, tort, negligence or otherwise, shall be limited to the price paid or payable for the specific service giving rise to the claim.

We shall not be liable for any loss of profit, loss of business, loss of data, or any indirect or consequential loss arising from the provision or non-provision of our rubbish clearance and waste collection services. We shall not be responsible for pre-existing damage, wear and tear, or deterioration of property or items we are asked to move or remove.

You are responsible for ensuring that any items you wish to retain are clearly identified and separated from waste. We cannot be held liable for the accidental removal or disposal of items that a reasonable person would consider to be waste or that were not clearly marked as to be retained.

Insurance

We maintain appropriate insurance cover in connection with the provision of our services, including public liability insurance, in line with common industry practice for waste collection and rubbish clearance providers in the UK. Details of our insurance can be made available upon reasonable request.

Complaints and Dispute Resolution

If you are dissatisfied with any aspect of our rubbish clearance or waste collection service, you should contact us as soon as possible with full details of your concern. We will investigate the matter and seek to resolve the issue promptly and fairly.

We may ask for supporting information, such as photographs or copies of documents, to assist our investigation. Where appropriate, we may offer to revisit the site, rectify any issues within our control, or provide another form of reasonable remedy. Our decision will take into account the specific circumstances and any evidence provided by both parties.

Data Protection and Privacy

We collect and use personal data, such as names, contact details, addresses and payment information, for the purpose of managing bookings, providing services, processing payments and handling customer queries. We take reasonable steps to keep this information secure and to use it only for lawful purposes connected with our rubbish clearance and waste collection activities or as required by law.

By using our services, you consent to our use of your personal data in accordance with applicable UK data protection legislation. You may contact us if you wish to access, correct or update the personal data we hold about you, subject to any legal restrictions.

Changes to these Terms and Conditions

We may update or amend these Terms and Conditions from time to time to reflect changes in law, regulation, industry practice or our business operations. The version in force at the time of your booking will apply to that particular service. We may, at our discretion, choose to apply updated terms to ongoing arrangements where reasonable to do so.

Governing Law and Jurisdiction

These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the provision of our services, shall be governed by and construed in accordance with the laws of England and Wales.

You and we agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the services provided by Rubbish Clearance Notting Hill.

Severability

If any provision of these Terms and Conditions is found by a court or other competent authority to be invalid, unlawful or unenforceable, that provision shall be deemed severed from the remaining provisions, which will continue to be valid and enforceable.

Entire Agreement

These Terms and Conditions, together with any written quote or booking confirmation issued by us, constitute the entire agreement between you and Rubbish Clearance Notting Hill in relation to the rubbish clearance and waste collection services we provide. They supersede any prior understandings, statements or agreements made between you and us, whether oral or written.

By placing a booking or permitting our team to commence work, you acknowledge that you have read, understood and agree to be bound by these Terms and Conditions.
